Welcome to EV Smart (“we,” “our,” or “us”). These Terms & Conditions govern your use of the EV Smart mobile application and services related to mobility, parcel delivery, and EV charging services.

By accessing or using EV Smart, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use EV Smart services.
By using the platform, you confirm that all information provided by you is accurate, complete, and up to date.

2. Nature of Service

EV Smart is a technology platform that connects users with independent drivers and service providers for:

City rides
Intercity rides
Rental rides
Parcel delivery services
EV charging station discovery and reservation services

EV Smart does not directly provide transportation or charging services unless explicitly stated.

Drivers and certain service providers are independent service providers and are not employees, agents, or partners of EV Smart.

3. User Responsibilities

As a user, you agree to:

Provide accurate pickup, drop-off, and booking information
Be present at the pickup location on time
Treat drivers, delivery personnel, and support staff respectfully
Use the platform only for lawful purposes
Comply with all applicable laws and regulations
Avoid misuse, fraud, GPS manipulation, or unauthorized activities on the platform

4. Booking & Service Agreement

A ride, parcel delivery, or charging reservation is considered confirmed once accepted or successfully processed through the platform.

By confirming a booking, you agree to:

Pay the applicable charges
Follow platform policies
Provide accurate service-related information

Additional charges may apply where applicable, including:

Tolls
Waiting charges
Parking charges
Parcel handling fees
EV charging-related fees

5. Pricing & Payments

Applicable fares or service charges may be displayed before confirmation, where technically feasible.

Payments may be made through:

Online payment methods supported via Razorpay
Cash payments (where available)

Users are responsible for ensuring valid payment methods and sufficient balance.

To the maximum extent permitted by law, EV Smart is not responsible for:

Payment gateway failures
Banking delays
Incorrect payments made by users
Third-party payment system interruptions

6. Cancellations

Users may cancel bookings subject to applicable cancellation policies and charges.

Drivers or service providers may also cancel bookings due to:

Incorrect locations
Safety concerns
Emergencies
Technical or operational issues

Repeated cancellations or misuse may result in temporary restrictions or account suspension.

7. No-Show Policy

If a user fails to appear at the designated pickup location or fails to cooperate during parcel pickup or delivery within a reasonable timeframe, the booking may be treated as a no-show and applicable charges may apply.

8. Driver & Service Provider Conduct

EV Smart strives to maintain service quality and safety standards.

However, EV Smart cannot guarantee the conduct, actions, or behavior of independent drivers or third-party service providers.

Users are encouraged to report misconduct, safety concerns, or suspicious activity through official support channels.

9. User Conduct

Users must not:

Harass, threaten, or abuse drivers, delivery personnel, or support staff
Use the platform for unlawful, fraudulent, or harmful activities
Provide false or misleading information
Attempt to bypass the platform for direct transactions
Send prohibited or illegal parcel items
Misuse promotional offers, referral systems, or payment systems

Violation of these Terms may result in:

Account suspension
Permanent account termination
Legal action where applicable

10. Parcel Restrictions

Users must not use EV Smart parcel services to transport prohibited items including but not limited to:

Weapons
Explosives
Hazardous materials
Narcotics or illegal substances
Live animals
Cash, jewelry, or illegal goods

Drivers may refuse unsafe or suspicious deliveries.

11. EV Charging Services

EV charging stations available through EV Smart may be operated by third-party providers.

Availability, pricing, charging speed, compatibility, and operational status may vary.

EV Smart does not guarantee uninterrupted charging station availability or performance.

12. Limitation of Liability

To the maximum extent permitted by applicable law, EV Smart acts only as a technology intermediary platform.

EV Smart shall not be liable for:

Accidents, injuries, or damages occurring during rides or deliveries
Delays caused by traffic, weather, technical failures, or unforeseen circumstances
Service interruptions beyond reasonable control
Loss or damage of personal belongings or parcel contents
Actions, omissions, or negligence of drivers or third-party providers

Nothing in these Terms excludes liability where prohibited under applicable law.

13. Service Availability

EV Smart does not guarantee uninterrupted availability of services at all times.

Service availability may be affected by:

Driver availability
Charging station availability
Traffic conditions
Internet connectivity
Technical maintenance
Operational or regional limitations

14. Account Suspension / Termination

EV Smart reserves the right to:

Suspend or terminate accounts involved in fraud, misuse, safety violations, or policy breaches
Restrict platform access where necessary for operational, legal, or security reasons
Refuse service at its reasonable discretion

15. Safety Features

EV Smart may provide certain safety-related features including:

SOS functionality
Emergency contact sharing
Live trip sharing
Unsafe behavior reporting

Availability of such features may vary depending on app version, service type, device compatibility, or region.

16. Changes to Terms

We may update these Terms from time to time.

Updated versions may be posted within the app, website, or official communication channels.

Continued use of EV Smart services constitutes acceptance of updated Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.
