Driver Terms & Conditions Effective Date: 29-04-2026
Welcome to EV Smart Captain (“EV Smart”, “Company”, “we”, “our”, or “us”).
These Driver Terms & Conditions govern the use of the EV Smart Captain mobile application and the employment-related responsibilities of drivers operating company-owned vehicles for mobility, parcel delivery, and related transportation services.
By registering, accessing, or using the EV Smart Captain application, you agree to comply with these Terms & Conditions.
1. Eligibility
To become a driver on the EV Smart Captain platform, you must:
- Be at least 18 years of age.
- Possess a valid Driving License.
- Provide valid Aadhaar and PAN details.
- Provide a recent selfie photograph for verification.
- Meet the Company's onboarding and verification requirements.
- Be legally eligible to work under applicable laws.
Providing false, misleading, or fraudulent information may result in suspension, termination, or legal action.
2. Employment Relationship
Drivers operating through EV Smart Captain are employees of EV Smart unless otherwise specified in a separate written agreement.
EV Smart provides company-owned vehicles and assigns transportation-related duties to eligible drivers.
Nothing in these Terms shall be interpreted as creating a partnership, agency, franchise, or independent contractor relationship where an employment relationship exists.
3. Driver Responsibilities
Drivers agree to:
- Operate vehicles safely and responsibly.
- Comply with all traffic laws and regulations.
- Maintain professional behavior toward customers, colleagues, and company representatives.
- Follow assigned trips, routes, and operational instructions.
- Report accidents, incidents, vehicle issues, or safety concerns promptly.
- Keep login credentials secure.
- Use the application only for authorized business purposes.
Drivers must not:
- Share accounts with others.
- Allow unauthorized persons to operate company vehicles.
- Misuse company property.
- Engage in fraudulent activities.
- Manipulate GPS or trip records.
- Create fake rides or transactions.
4. Company-Owned Vehicles
Vehicles used for EV Smart operations remain the property of the Company.
Drivers are responsible for:
- Proper care of assigned vehicles.
- Reporting vehicle damage immediately.
- Following company vehicle usage policies.
- Returning company property when requested.
Drivers shall not:
- Use vehicles for unauthorized personal activities.
- Transfer vehicle possession without approval.
- Modify company vehicles without authorization.
5. Driver Earnings & Salary
Eligible drivers shall receive compensation as determined by the Company and communicated separately.
Compensation may include:
- Monthly salary
- Approved overtime payments
- Performance-based incentives
- Additional task-based incentives
Salary, incentives, and reimbursements may be subject to applicable deductions required by law or company policy.
The Company reserves the right to modify compensation structures in accordance with applicable laws and internal policies.
6. Cash Collection Responsibilities
Drivers may collect cash payments from customers where applicable.
Drivers must:
- Accurately report collected amounts.
- Deposit or submit collected cash according to company procedures.
- Settle collected cash before logging out or within the timeframe specified by the Company.
Failure to properly account for collected cash may result in:
- Recovery from salary or pending payments where permitted by law.
- Disciplinary action.
- Suspension or termination.
- Legal proceedings where applicable.
7. Incentives & Additional Tasks
The Company may provide:
- Overtime incentives
- Performance incentives
- Special task incentives
- Promotional campaign incentives
Incentives are discretionary and may be modified, suspended, or withdrawn by the Company at its reasonable discretion.
8. Customer Service Standards
Drivers are expected to:
- Treat customers respectfully.
- Maintain professional conduct.
- Avoid discrimination or harassment.
- Provide reasonable assistance during trips and deliveries.
- Follow safety and service quality standards.
Customer complaints may be investigated and may affect eligibility for incentives, continued employment, or platform access.
9. Driver Ratings & Performance Monitoring
EV Smart may monitor:
- Customer ratings
- Service quality
- Attendance
- Route compliance
- Safety records
- Operational performance
Consistently poor performance or ratings may result in:
- Coaching or retraining
- Temporary suspension
- Restriction of duties
- Termination of platform access or employment
10. Prohibited Conduct
Drivers must not:
- Use fake GPS applications.
- Manipulate location data.
- Create fraudulent rides or transactions.
- Harass customers or employees.
- Drive recklessly or dangerously.
- Operate vehicles under the influence of alcohol, drugs, or prohibited substances.
- Engage in criminal or unlawful activities.
- Share confidential company information.
Violations may result in immediate suspension, termination, and legal action.
11. Safety Requirements
Drivers must:
- Follow all applicable road safety regulations.
- Use required safety equipment.
- Immediately report accidents and emergencies.
- Cooperate with investigations relating to safety incidents.
The Company may suspend drivers where continued operation presents a safety risk.
12. Account Suspension & Termination
EV Smart may suspend, restrict, or terminate driver access for reasons including:
- Fraudulent activities
- Fake GPS usage
- Fake rides
- Dangerous driving
- Customer harassment
- Criminal complaints
- Document verification issues
- Policy violations
- Poor performance or ratings
- Failure to comply with company procedures
Suspension or termination may occur without prior notice where necessary for safety, legal, or operational reasons.
13. Application Usage
Drivers agree to use the EV Smart Captain application only for authorized business purposes.
The application may collect operational information including:
- GPS location data
- Trip information
- Device information
- Performance-related information
Such information may be used for operational, safety, compliance, payroll, and service improvement purposes.
14. Limitation of Liability
To the maximum extent permitted by law, EV Smart shall not be liable for:
- Service interruptions
- Mobile network failures
- Technical errors beyond reasonable control
- Losses resulting from unauthorized account access caused by driver negligence
- Indirect or consequential damages where permitted by law
Nothing in these Terms limits rights that cannot legally be excluded under applicable law.
15. Service Availability
Application functionality may be affected by:
- Technical maintenance
- Internet connectivity
- Device compatibility
- Operational requirements
- System upgrades
EV Smart does not guarantee uninterrupted platform availability.
16. Changes to Terms
EV Smart may modify these Terms from time to time.
Updated versions may be published through:
- The EV Smart Captain application
- Company websites
- Official communication channels
Continued use of the platform after updates constitutes acceptance of the revised Terms.
17. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Narsinghpur, Madhya Pradesh, India.
